What do I Need to Think About?

The breakdown of a relationship, whether you are married or a cohabiting couple, inevitably brings with it emotional stress and unhappiness, not only to the adults involved but also the children.

There are steps you can take which will help everyone at such a difficult time to cope and manage their particular situation better.

  • You will be asked if you wish to consider Mediation or an appointment with Relate (Marriage Guidance), especially if you need Public Funding (Legal Aid) so it would be helpful if you could think about this before you come for your first appointment.

  • Whilst the relationship between the parents might have broken down and be distressing, it is important to remember that the children will normally love both parents and will find it difficult to cope with the adult conflict. It is important to try to make arrangements which allow the children to enjoy and maintain a loving relationship with both parents. This can help to make the whole process easier for the children

  • We will ask you to let us know if there are any assets which need to be immediately protected if you feel your partner might move them elsewhere, making these assets difficult to find at a later date.

  • We will also discuss with you whether or not you need to take steps to protect your home or your right to occupy your home

  • If you are suffering from abuse or violence of any sort it may be possible to obtain Court Orders to protect you and any children. It is important that you come to see us as soon as possible. Remember that violence can cover shouting, intimidating behaviour and threats as well as hitting, punching, kicking and other forms of physical violence.

    DO NOT BE EMBARRASSED

If you tell us what has been happening we can advise you of the legal steps you can take to protect yourself.
